In Florida, many Criminal cases result in a sentence that includes probation. Probation is often used in place of a jail and prison sentence and can follow incarceration. If you violate your probation, commonly referred to as a VOP, you have committed a new offense. Because the probation was essentially a substitute for incarceration, many Courts take the stance that because you cannot comply with the terms of probation, you should complete the remainder of your sentence in jail instead.
Additionally, the State of Florida must prove that the violation occurred by a "preponderance of the evidence" standard, instead of the more difficult "beyond a reasonable doubt" standard.
